I'd like to know where most anti's have been. I honestly think these people need to gett a life outside of fandom. Or at least let fanfom and non-fandom worlds mingle every no and then. Then maybe they'd realise that to the outside world, there is no difference between FPF and RPF, and people don't see us as evil or cool, just as slightly freaky geeks.

(Note: obviously, when I say 'anti's', I do mean the rabid ones, not the mere non-RPS people.)

Of course, pointing that out to people isn't gonna get me anywhere. I'm starting to get really jaded about this whole issue. I've been through the motions so many times I can make up an RPF argument on the spot. Proof:

Anti: "It's illegal!"
Me: "The illegality of RPF is doubtful at best. <lots of elaoration, mostly stolen from Vali> And anyway, the illegality of FPF is much more certain and more likely to be actually sued. There are examples known of people being faced with C&D letters for FPS, whereas RPF has been published in public forums such as Penthouse, etc., and has been safe thus far. There are even a number of lawsuits which could be used as precedents, should it ever come to an actual RPF lawsuit. <insert examples here>

Anti: "It's immoral!"
Me: "According to whom? You think it's immoral. Many people don't. Not everybody shares the same set of morals. Many people think FPS is immoral. A number of people even think FPF is immoral. What is the difference between them telling you we can't write this and you telling me I can't write RPF?
Anti: "But RPF can hurt the subject!"
Me: "So can FPF. In fact, there are documented cases of actors being hurt and insulted by FPF."

And so further, and so on. But of course, I have a flawed perspective. And lots of sarcasm to go with it, too.

Why does FPS keep coming up as illegal? I don’t know, but I’d assume that it’s less because it’s slash than because the authors are in breach of copyright. Fictional pieces are far more diligently protected than the rights of individuals – which is why we still have tabloids (ouch, I know, no comparison but it had to be said).

I don’t see anything wrong with either FPS / RPS myself (so long as it’s accompanied by suitable disclaimers, yadda yadda). I was just curious as to whether it’s known whether the FPS sites were being stamped on because they were slash or because they fell under the envelope of fanfiction. (And in the former case, whether the authors / copyright owners were explicitly stating in the C&Ds that it was site content, and were known to not target more general fanfic sites)

Welll, FPS is 'more illegal' than RPS, becuase one would have a hard time proving that RPS is libel, whereas FPS is quite clearly copyright breech.

I don't know, but I know Anne Rice has vetoe'd all VC fanfic, not just slash. And I know there's C&D's being thrown at all sorts of fansites, not even just the fanfic nes?. In fact, having screencaps and scripts on a site will get you C&D'ed faster than fanfic.

I'm rambling.
